TERMS and CONDITIONS

Payment may be made by credit or debit card over the telephone. We accept all major credit cards except American Express and Diners Club. Payment by cheque will require receipt of cleared funds prior to the order being despatched. Full payment must be received by Broadway Deli before any order will be accepted.

Any claim arising from this agreement will be subject to the laws of England and Wales and parties hereto agree to the exclusive jurisdiction of the English Courts.

Delivery

Standard delivery of the hampers listed to addresses to England, Wales, Scotland (excluding Highlands and Islands), Northern Ireland, Isle of Man and Scilly Isles addresses costs £16.95. Delivery to the Highlands and Islands of Scotland is £17.95. We regret we are unable to accept orders for delivery addresses outside the UK. All our gift hampers are sent by courier (Parcelforce). Orders placed before 12.00 (Monday-Thursday) are sent by 48 hour delivery service, subject to Parcelforce’s terms and conditions.

The courier is not able to specify time of delivery. A signature is required on delivery. If the recipient is out the courier will leave a card asking the recipient to make contact to arrange a second delivery attempt. Two weekday delivery attempts are included in the delivery charge. Subsequent delivery attempts and address re-directions after despatch are chargeable (price on application). If the recipient fails to make contact with the courier in good time, the goods will be automatically returned to Broadway Deli and a charge will be made for the return and re-delivery of the goods to the original or alternative address. The purchaser will also be charged for any items which have become unsuitable for sale and need replacing.

Substitutions

All items shown are subject to availability. In the event of unavailability, Broadway Deli reserve the right to substitute these with a similar item(s) of equal or greater value or suggest an alternative.

Cancellation of Order

Broadway Deli reserves the right to refuse or cancel any order made until such time as the item(s) are despatched. In the unlikely event that an order needs to be refused or cancelled, you will be informed by email and/or telephone and a full refund made. You have the right to cancel an order without incurring any financial penalty at any time until the item(s) have been despatched. Once the order has been despatched you may still cancel the order, however you will remain liable to pay for the cost of delivery together with any and all perishable or rapid expiry items.

Please note that as gift hampers are made up of various items contained in a singular package which include perishable and items with rapid expiry dates, your legal right to cancel the order within the 7 day “cooling off” period does not apply and is expressly excluded.

Delivery Address Information

Please note that after despatch, any changes to the hamper delivery address will incur additional charges. We will deliver to the address as you provide it and cannot accept any liability for late or failed delivery if the quoted address is incorrect or incomplete. If you are not sure of the address we would recommend you check before proceeding with your order. We regret that we are not able to accept orders to an address containing a PO Box number.

Returns Policy

It is the policy of Broadway Deli to ensure that all our goods are supplied to our customers in perfect condition and that every possible precaution is taken to protect the integrity of the product that is sold. To this end, we do not exchange food, beverage or any other item that has come into contact with the person. This policy does not affect your statutory rights.

Claims

Claims for damage or loss in transit will be met provided the goods are signed for on receipt as either ‘damaged' or ‘unexamined' and we are informed at once and confirmed in writing within 3 days of delivery. Damaged goods must be retained for inspection and Broadway Deli may wish to make arrangements for return of the goods to us at our expense. Returned goods should be clearly marked with the senders name and address. Our liability is limited to the selling price of the goods in all cases.

Alcohol

It is illegal to sell alcohol to persons under the age of 18. It is also an offence for persons under 18 to buy, or attempt to buy alcohol. No person under the age of 18 may place a hamper order with or receive a hamper order from Broadway Deli if the goods contain alcohol. On placing an order you are confirming to be over 18 years of age. You may be asked to verify this when you call to make payment.

Data Protection

Broadway Deli is compliant with the Data Protection Act. We will not pass your details on to any third party organisation and will treat your details with complete confidentiality. We may occasionally send you promotional material relating to Broadway Deli only. If you do not wish to receive such material then please write to us and we will remove your details from our mailing list. The information we hold will be accurate and up to date. You can check the information we hold about you by contacting us and if you find any inaccuracies we will delete or amend them.
